Judge Temporarily Blocks Enforcement of NYC Self-Storage Rules
New York City cannot enforce its new self-storage pricing legislation until Dec. 15 under a temporary restraining order issued last week by Staten Island Judge Ralph Porzio.
The order follows a lawsuit brought by the New York Self Storage Association, the national Self Storage Association (SSA), and U-Store Self Storage challenging the requirements, according to an Oct. 26 email newsletter sent to SSA members.
The legislation would require operators to publicly disclose competitive pricing information, permit customers with unpaid balances to retrieve certain belongings without payment, and comply with residential-cleanliness standards. Penalties for noncompliance were scheduled to take effect Nov. 1.
The court will consider the city’s request to transfer the case from Staten Island to Manhattan, along with the plaintiffs’ request for an injunction permanently blocking the rules. New York City attorney Randy Mastro represents the plaintiffs.
